The criminal lawyer exerts criminal law, carry a case and act in a court, representing and defending the interests of one or more persons who denounce or are defendants in criminal proceedings (acts comprised in a legal process), and guarantee their defense.
Criminal law covers all acts described as a crime or an offense in the Criminal Code, including: offenses against public administration, as influence peddling; economic crimes such as money laundering; or crimes against persons, as homicide.
The criminal lawyer can be private or "party", when is paid by a private client, or "trade", when is designated by a Bar Association and free for the person to be defended.
Criminal lawyers typically work as freelancers in law firms.


The main tasks carried out by the criminal lawyer are:
  • Client assistance and advice at all stages of the criminal proceedings and acts: beginning, complaint/grievance, research/instruction, imputation, accusation, judgment and execution of judgment. This task includes client support during the trial, if necessary.
  • To find the most favorable and fair interpretation of the law according to the client¿s interests.
  • To present requests to search evidence and necessary resources according to the law, and to defend the interests of his client.
  • To develop specialized criminal dictums: criminal decisions and positions on a particular hypothesis.
  • To write criminal documentation: legal technical reports, responses to notifications, trial criminal instances, contracts, requests or complaints.
