Description

The labor lawyer is a professional dedicated to exerting labor law and ensures compliance with labor regulations. This candidate must know and use the set of legal rules and principles governing the relationships between workers and employers.The labor lawyer working sphere corresponds to labor law advice, both to workers and firms, to the dialogue between them and to represent their interests in a court. He or she can be specialized in different areas: individual, collective and Social Security labor law.
The labor lawyer may work in a law firm, a law office or a company (usually large corporations), performing different tasks in one of the aforementioned branches.
The labor lawyer can be private or "party", when he or she is appointed and paid by a client, or "trade", when he or she is designated by a Bar Association and it¿s free for the person to be defended. In both cases, the lawyer can be a freelancer ¿the most usual case- or wage earner.

Tasks

The labor lawyer working in a law firm may have many customers among employers and employees, whereas labor lawyers working in a law office often advise companies (usually medium or small, which outsource the management of labor issues). In both cases, the tasks to be developed correspond to legal advice and are the following:
  • To adapt the contract to the activity to be developed, its duration, worker's situation, etc.
  • To process sick leaves, layoffs and compensations (dismissal, disability, accident, etc.), or penalties for non-compliance with regulations.
  • To manage job layoffs or modifications in collective labor rights.
  • To advise on labor union relations.
  • To manage issues related to Social Security.
A labor lawyer employed in a company works in the defense of the company¿s interests performing the following tasks:
  • To manage the company¿s legal department (collective agreement, implementation of labor laws, etc.).
  • To coordinate with other departments of the company; to arbitrate between staff and management in conflicts and doubts that may arise on different topics, such as payments, scheduling, holidays, seniority, etc.
  • To advise on the negotiations with business committee to resolve conflicts and propose solutions.
  • To represent the company in processes related to labor issues (labor inspections, workforce reduction, etc.) and in the application of the disciplinary system.
  • To collect information, to find evidences and to make the necessary steps to ensure the defense of the company¿s interests.
